1. Your agreement with us
These Terms of Use apply to Catcharium: Fish ID & Log, its online recognition service, and this website, provided by Fria LLC ("we", "us", or "our"). By using these services, you agree to these terms. If you do not agree, do not use the services.
You must be at least 13, or the higher minimum age required where you live. If you have not reached the legal age to enter this agreement, your parent or guardian must review and agree to these terms and supervise your use.
2. App Store license and Apple terms
The iOS app is licensed under Apple's Standard Licensed Application End User License Agreement (EULA). These terms supplement that license for Catcharium's services; they do not replace Apple's standard EULA. If there is a conflict concerning the app license, the standard EULA controls. Apple's applicable App Store and payment terms also apply.
Fria LLC provides Catcharium and its support. Apple is not responsible for providing support for our service. Nothing here limits any rights or responsibilities that cannot be excluded under the standard EULA or applicable law.
3. Identification, measurement, and fishing safety
Catcharium offers photo-based species suggestions, estimated or device-assisted length measurements, a species guide, and a personal catch journal. Results are informational and may be inaccurate, incomplete, or unavailable. Similar species, poor lighting, camera perspective, depth data, and image quality can affect results. You can correct recorded lengths, but the app is not a certified measuring instrument.
Do not rely on Catcharium to determine whether an animal is safe to handle or eat, whether a species is protected, whether fishing is allowed, or whether a catch meets legal size, season, or bag limits. Consult authoritative local rules and qualified experts and use appropriate physical measurements. Follow licenses, access restrictions, conservation rules, and safe practices around water, wildlife, hooks, and equipment.
4. Your photos and catch journal
You retain rights to your photos and catch journal. You give us permission to process submitted photos and related records to provide recognition and, in versions with Account & backup, to store them for private backup and recovery. Only submit content you have the right to use. See our Privacy Policy for retention and deletion details.
Saved catches remain on your device. Where cloud backup is available, they can also be backed up to an anonymous account, and submitted scans that are not saved as catches are scheduled for cleanup after 90 days from server-record creation. Recovery depends on a completed backup and retaining access to that same account. We do not currently offer account linking or guaranteed recovery after changing devices or losing credentials. Keep independent copies of photos that matter to you.
5. Free access, Pro, and purchases
Some features are available without payment, subject to the limits shown in the app. Catcharium Pro may be offered as a monthly or annual auto-renewing subscription or as a one-time lifetime purchase. Available plans, included features, prices, currencies, billing periods, and any introductory offers are shown before you confirm a purchase. The App Store purchase sheet controls the final price and billing terms.
- Payment is charged to your Apple Account when you confirm the purchase, subject to any trial or offer displayed by Apple.
- Auto-renewing subscriptions renew unless canceled at least 24 hours before the current period ends. Apple may charge for renewal within the 24 hours before the end of that period.
- You can manage or cancel subscriptions in your Apple Account subscription settings. Cancellation ordinarily takes effect at the end of the paid period. Deleting Catcharium or emailing us does not cancel an Apple subscription.
- If a free trial or introductory offer is available, its eligibility, duration, and price after the offer are disclosed at purchase. Any unused trial portion may be forfeited when you purchase a subscription, as provided by Apple's terms.
- A lifetime purchase is a one-time, non-renewing purchase of the advertised Pro access for the operating life of Catcharium. It does not promise that the service will operate forever or include separate future products. Your mandatory consumer rights remain unaffected.
- Use Restore Purchases in the app with the Apple Account that made the purchase to recover eligible access. Refund requests are handled through Apple at reportaproblem.apple.com, subject to Apple's rules and applicable law.
Subscription and purchase status is verified using Apple and RevenueCat. Refunded, revoked, or expired purchases may no longer provide Pro access. We will honor applicable notice, consent, refund, and consumer-law requirements when changing paid offerings.
6. Appropriate use and availability
Use the service lawfully and for its intended purpose. Do not bypass purchase checks or usage limits, automate abusive request volumes, interfere with the service, attempt unauthorized access, or infringe others' rights. Restrictions on reverse engineering apply only to the extent permitted by law and the app license.
Recognition requires an internet connection and depends on third-party services. Temporary rate limits, maintenance, outages, or provider changes may affect availability. Pro access does not remove reasonable security controls. We may restrict access when reasonably necessary to address abuse, security, or legal requirements and will provide notice when practicable.
7. Ownership and third-party services
Except for your content and third-party materials, Catcharium's software, design, branding, and other materials belong to Fria LLC or its licensors. Your right to use the app is governed by the license described above. Third-party materials remain subject to their applicable licenses.
Apple, RevenueCat, cloud providers, and external websites may have their own terms. Our Privacy Policy explains the providers used to process information for Catcharium.
8. Warranties and responsibility
To the extent permitted by law, the service is provided as available, without a promise that all identifications or measurements will be correct or that access will be uninterrupted. Fria LLC is not responsible for decisions made solely on an unverified AI result.
To the extent permitted by law, we exclude liability for indirect or consequential losses arising from use of the service. These terms do not exclude or limit liability for fraud, willful misconduct, gross negligence, death or personal injury where such liability cannot be excluded, or any other non-excludable liability. They do not remove statutory warranties, refund rights, or other mandatory consumer protections.
9. Ending use and changes
You can stop using Catcharium at any time. Manage any active subscription separately through Apple. Content deletion and privacy requests are explained in the Privacy Policy.
We may update features or these terms. We will post the updated terms with a new effective date and provide appropriate notice of material changes. Changes will not retroactively remove accrued rights. Where required, we will seek your agreement before a change takes effect. If we discontinue a paid service, applicable consumer rights and any required remedies continue to apply.
10. Applicable law and contact
These terms are governed by the laws of Wyoming, United States, except that mandatory protections and rights to bring claims in your home jurisdiction remain available where applicable. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
